Start with EB-2 eligibility

USCIS identifies advanced-degree professionals and people of exceptional ability as the two EB-2 groups. A request for a national interest waiver does not remove the need to qualify for the underlying classification.

Then consider the waiver

The waiver concerns the job-offer and labor-certification requirements. It is not an automatic benefit of holding a degree. A consultation should address both classification and the evidence for the proposed waiver.

Prepare for review

Bring your education and work history and a clear explanation of the work you propose to pursue. Counsel must assess the actual evidence and current requirements.

USCIS supplement: this specific eligibility distinction is not covered in the reviewed video transcripts. Based on the January 15, 2025 policy alert; not a prediction of approval.
